Terms of service

Last updated:

1. Introduction

Welcome to theBizness.ai ("we," "our," or "us"). These Terms of service ("Terms") govern your access to and use of the theBizness.ai platform, including our website, analytics dashboard, tracking script, APIs and Stripe integration features (together, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy policy and Refund policy. If you use the Service for a company or other organization, you confirm that you may bind it to these Terms. If you do not agree, do not use the Service.

2. The Service

theBizness.ai is a privacy-focused analytics platform. It connects UTM and referrer tracking on your website with your Stripe payments, so you can see which marketing channels produce revenue.

2.1 UTM and visitor tracking

The tracking script you install records pageviews, UTM parameters, referrers, device and approximate location (derived from the visitor's browser time zone) and the custom events and conversions you choose to send. It sets first-party cookies on your domain, as described in our Privacy policy.

2.2 Stripe integration

When you connect Stripe, you give us a restricted API key that you create. We use it to read your sales, refunds, subscriptions and cancellations and to create and remove the webhook endpoint that sends us those events. We attribute each sale to the visit that came before it. You can disconnect Stripe at any time from your website's configure page. Disconnecting removes our webhook endpoint from your Stripe account and deletes the key from our systems. Revenue we already recorded is kept.

2.3 AI insights

The dashboard can generate written suggestions from aggregated analytics for a website. These are automatically generated, may be incomplete or wrong, and are not professional advice. You decide whether to act on them.

3. Your account

To use the Service you must create an account. You must be at least 16 years old, and you agree to provide accurate information and to keep it up to date. We send a verification link to the address you sign up with. Please confirm it, because password reset emails are sent there.

You are responsible for your password, for the sign-in methods you use, for your website's ingest secret and for all activity under your account. Keep your ingest secret on your server only. Never put it in browser code. Tell us immediately at [email protected] if you suspect unauthorized use. You can sign out of all devices and delete your account from your account settings.

4. Your responsibilities

4.1 Implementation

You are responsible for installing the tracking script and configuring the Stripe integration as described in our documentation. Incorrect implementation can make your analytics inaccurate.

4.2 Legal compliance and your visitors

For the personal data of your website visitors and customers that you collect through the Service, you are the controller and we act as your processor. You agree to:

  • use the Service in compliance with all applicable laws and regulations;
  • describe the data collected through the Service in your own privacy policy;
  • obtain the consent, or rely on another legal basis, that applies in your jurisdiction (for example under the GDPR, the ePrivacy rules or the CCPA) before the script runs; and
  • not send us data you have no right to send, such as passwords, payment card numbers, government identifiers or health information.

If you need a data processing agreement for your records, email [email protected].

4.3 Data accuracy

We work to provide accurate analytics, but no tracking system is complete. Ad blockers, browser privacy settings, network problems and consent choices can all prevent events from being recorded. Revenue reported from a visitor's browser is unverified. Revenue that Stripe reports to us, and revenue you send from your server with your ingest secret, is shown as verified.

5. Acceptable use

You agree not to:

  • use the Service for anything unlawful, deceptive or harmful;
  • attempt to access another customer's data or accounts, or probe, scan or test the Service's security without our written permission;
  • interfere with the Service, send traffic designed to overload it or evade its rate limits and plan limits;
  • send events for a website you do not own or control;
  • copy, resell or reverse engineer the Service, except where the law allows it despite this restriction.

6. Subscriptions, free trial and billing

6.1 Plans and prices

Subscriptions are billed monthly in US dollars through Stripe, and renew automatically every month until you cancel. Our current plans are:

  • Starter: $5 per month, up to 1,000 tracked events per month
  • Pro: $15 per month, up to 5,000 tracked events per month
  • Growth: $29 per month, up to 25,000 tracked events per month

We may change prices or plans. We will tell you before a change, and it applies from your first renewal after that notice.

6.2 Free trial

  • The free trial lasts 7 days and gives you full access to the plan you choose.
  • A payment card is required to start the trial. Nothing is charged during the trial.
  • The trial converts to a paid subscription automatically. Your card is charged when the 7 days end, and then every month.
  • Each customer gets one free trial. If you have already had a trial or a subscription, a new plan starts with a normal charge.
  • If you cancel before the trial ends, you are not charged.

6.3 Cancellation

You can cancel at any time from Billing in your dashboard (Manage billing). A canceled subscription stays active until the end of the period you paid for and does not renew. See the Refund policy for refunds. If you delete your account, your subscription is canceled immediately instead (see section 8.2).

6.4 Plan changes

You can upgrade at any time. A downgrade takes effect at the end of your current billing period.

6.5 Failed payments

If a payment fails, Stripe retries it and we show a banner with a link to update your payment method. You keep full access for 7 days after the payment was due. If it still has not been paid after that, your account is suspended: tracking pauses (pageviews, events and conversions are no longer recorded) and the dashboard is locked until the payment goes through. Revenue that Stripe reports to us is still recorded, so your reports are complete when you return. We keep your data while your account is suspended.

7. Plan limits

Each plan includes a number of tracked events per billing period.

  • What counts. A tracked event is a custom event you send, or a revenue or conversion event recorded for your websites, whether it comes from Stripe, from your server or from a visitor's browser. Usage is counted across all your websites. Pageviews and visitor counts are not counted and are never limited. A visit that matches one of your URL conversion rules is recorded as a conversion and counts as one tracked event. A purchase event that includes an amount is recorded as a custom event and as a sale, so it counts as two tracked events. An event without an amount counts as one. Refunds, $0 payments, Stripe test-mode payments and the conversion rules themselves are not counted.
  • At 100% of your limit your dashboard and billing page show a warning. Everything keeps being recorded.
  • Up to 120% of your limit (1,200 on Starter, 6,000 on Pro, 30,000 on Growth) nothing is dropped. Beyond that, custom events and revenue or conversions reported from a visitor's browser are not recorded for the rest of the billing period.A purchase event with an amount needs room for both of its events, so it can be refused when fewer than two events remain below the cap.
  • Daily allowance per address. To keep one visitor, bot or script from using up your allowance, custom events, sales and conversions reported from a visitor's browser are also limited for each IP address and website to 10% of your plan's tracked-event limit per UTC day, with a minimum of 100 and a maximum of 2,500(100 on Starter, 500 on Pro, 2,500 on Growth). Events over it are not recorded or counted against your plan until the next UTC day. It does not apply to events you send from your own server with your ingest secret, or to revenue that Stripe reports to us.
  • Always recorded. Revenue that Stripe reports to us is always recorded. Events you send from your own server with your ingest secret are recorded without the cap while your subscription is active. You can upgrade at any time to raise your limit.
  • Renewal. Usage starts again at zero when your billing period renews.

Requests that are not recorded receive an explicit response from our API, so your own systems can tell.

8. Your data and privacy

8.1 Your data

You keep all rights to the data collected from your websites through the Service. You give us a limited license to host, process and display it as needed to provide the Service to you. We do not sell your data.

8.2 Retention and deletion

Raw pageview, custom event and conversion event records are deleted automatically after 25 months. Revenue records are kept while your account exists. When you delete your account (Settings in the dashboard) we cancel your subscription immediately, with no refund of the unused part of the period, remove our webhook endpoints from your connected Stripe account, delete your websites and all data associated with them, and delete your account. Other devices where you are signed in are signed out within about 5 minutes. Payment and invoice records stay in Stripe for tax and accounting. The Privacy policy has the details.

8.3 Security

We use reasonable technical and organizational measures to protect the Service and your data, including hashed passwords and encryption of the Stripe keys and secrets you store with us. No system is completely secure, so we cannot guarantee absolute security.

9. Intellectual property

The Service, including its software, design and content, belongs to theBizness.ai and is protected by copyright, trademark and other laws. We grant you a limited, non-exclusive, non-transferable and revocable license to use the Service for your own business purposes, subject to these Terms.

10. Third-party services

The Service relies on third parties, including Stripe for payments, Google for sign-in, and the providers listed in our Privacy policy. Your use of Stripe is also governed by Stripe's own terms. We are not responsible for third-party services.

11. Disclaimer of warranties

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that the Service will be uninterrupted, error-free or that the data it reports will be complete or accurate.

12. Limitation of liability

To the maximum extent permitted by law, theBizness.ai is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, use or goodwill, arising from your use of, or inability to use, the Service.

Our total liability for any claim related to the Service is limited to the amount you paid us for the Service in the 12 months before the claim.

13. Indemnification

You agree to defend, indemnify and hold harmless theBizness.ai and its officers, directors, employees and agents from claims, damages, losses and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your violation of law, or the data you collect through the Service.

14. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if your use puts the Service or others at risk, or if a payment fails and is not resolved (see section 6.5). Where practical we will tell you why. Sections that by their nature should survive termination do survive it.

15. Changes to these Terms

We may update these Terms. For a material change we will give you at least 30 days' notice by email or in the dashboard before it takes effect. If you keep using the Service after the change takes effect, you accept the updated Terms. The "Last updated" date above shows the current version.

16. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law rules. Before starting a formal proceeding, each of us agrees to try to resolve the dispute informally by contacting the other.

If the dispute is not resolved informally, it will be decided by binding arbitration under the rules of the American Arbitration Association, except that either of us may bring a claim in small claims court, and either of us may ask a court in the State of Delaware for injunctive relief to protect intellectual property or confidential information. Where the law does not allow a dispute to be arbitrated, the state and federal courts located in Delaware have exclusive jurisdiction.

17. General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions stay in effect. You may not assign these Terms without our consent. These Terms, together with the Privacy policy and Refund policy, are the entire agreement between you and theBizness.ai about the Service and replace any earlier agreement about it.
